Subscription Agreement
1. Introduction
This Subscription Agreement is entered into between you and the developer of Vintx regarding your subscription to the premium features of the Vintx mobile application. Vintx is a postcard-themed photo editing app that allows users to create, edit, save, share, and manage postcard-style images. By subscribing to Vintx Premium, you acknowledge that you have read, understood, and agree to be bound by all the terms and conditions set forth herein. Please read this Agreement carefully before purchasing a Subscription; if you do not agree to any of these terms, you must not subscribe to Vintx Premium. It is important to note that Vintx does not collect any facial information from users, and all image-related data processed through the App, including those created with premium features, is stored locally on your device to protect your privacy.
2. Subscription Definitions and Premium Features
- 2.1 Vintx Premium: Refers to the paid subscription service that unlocks additional exclusive features within the Vintx App, beyond the core free functionality available to all users without a Subscription.
- 2.2 Core Free Features: Include the ability to select images from your device’s photo album, generate postcard effects with white irregular borders, add basic draggable and resizable text with default fonts, add simple image watermarks, save edited works to the in-app gallery, and export images to your device’s system album or share them via your device’s system sharing function.
- 2.3 Premium Exclusive Features: Include access to the full library of premium fonts from Google Fonts, advanced custom text color gradients and effects, high-resolution image export options, an ad-free editing experience, priority access to new postcard templates and border designs, and the ability to create and save custom text and watermark presets for quick reuse.
- 2.4 Subscription Term: Refers to the duration for which you retain access to Vintx Premium benefits, as selected by you at the time of subscription. All Subscription terms are non-transferable and apply solely to the User who purchased the Subscription.
3. Subscription Purchase and Payment
- 3.1 Payment Processing: All Subscription payments are processed exclusively through your device’s native payment system. The Provider does not collect, store, or have access to your payment card details, bank account information, or any other financial data. All payment-related transactions are handled directly by the applicable app store, in accordance with their own terms of service and privacy policies.
- 3.2 Pricing and Currency: Subscription prices are displayed in the currency applicable to your device’s region settings at the time of purchase and are subject to change upon prior notice published within the App. The Provider reserves the right to adjust Subscription prices for new subscriptions, but existing subscribers will not experience price changes during their active Subscription term. Any pricing changes will take effect only for new Subscription purchases or renewals after the change is announced.
- 3.3 Auto-Renewal: By default, all Subscriptions are set to auto-renew at the end of the current term to ensure uninterrupted access to Premium features. You may disable auto-renewal at any time through your device’s app store account settings (e.g., Apple ID, Google Play Account) at least 24 hours before the end of the current Subscription period. If auto-renewal is not disabled, your payment method will be automatically charged for the next Subscription term at the current price applicable to your region at the time of renewal.
- 3.4 Refund Policy: Subscription refunds are granted in accordance with the policies of the applicable app store (Apple App Store/Google Play). The Provider will not process refund requests directly; all refund inquiries must be submitted through the relevant app store’s customer support channel. Refunds are typically not provided for partial Subscription terms, except as required by applicable law or the app store’s refund policy. To request a refund, you must first cancel your Subscription (if auto-renewal is enabled) and then submit a refund request through the app store’s designated platform (e.g., reportaproblem.apple.com for Apple App Store users).
4. Subscription Access and Usage
- 4.1 Activation: Upon successful payment confirmation from the app store, your Vintx Premium Subscription will be activated immediately, and you will gain access to all exclusive premium features for the duration of your selected term. Activation is automatic and does not require any additional steps, such as account registration.
- 4.2 Device Compatibility: Premium features are available on all devices that meet the App’s minimum system requirements and are logged into with the same app store account used for the Subscription purchase. You may share Subscription access with up to 5 devices associated with your app store account, provided all devices are used for personal, non-commercial purposes only. Commercial use of the Subscription or Premium features is strictly prohibited without the Provider’s prior written consent.
- 4.3 Usage Restrictions: You may not use Vintx Premium features for commercial purposes, including but not limited to selling edited images created with Premium features, using Premium features in paid services, distributing edited works for profit, or using the App to create content for commercial clients. Unauthorized commercial use will result in the immediate suspension or termination of your Subscription, with no refund provided for the remaining term. Additionally, you may not share your Subscription access with individuals who are not associated with your app store account, or use the Premium features to create content that violates applicable laws, regulations, or the App’s User Agreement.
- 4.4 Data Privacy and Storage: All images you upload, edit, or generate using Vintx Premium features are stored exclusively locally on your device. The Provider’s backend systems do not access, store, or transmit any of these images or related editing data. As previously noted, Vintx does not collect any facial information from users, ensuring that your content remains private and under your full control at all times.
5. Subscription Termination and Cancellation
- 5.1 Voluntary Cancellation: You may cancel your Subscription at any time through your device’s app store account settings. Cancellation takes effect at the end of the current Subscription period, and you will continue to have access to Premium features until that time. No refunds will be provided for the remaining portion of the current term, except as required by applicable law or the app store’s refund policy.
- 5.2 Involuntary Termination: The Provider may suspend or terminate your Subscription immediately, without prior notice, if you violate any terms of this Agreement. This includes, but is not limited to, unauthorized commercial use, sharing Subscription access with non-authorized users, abusive behavior towards the App’s support team, infringement of third-party intellectual property rights, or using the Premium features to create illegal or inappropriate content. In such cases, no refunds will be provided for the remaining Subscription term, and you may be restricted from purchasing future Subscriptions.
- 5.3 Post-Termination Rights: Upon Subscription termination or expiration, you will lose access to all Premium exclusive features, but your previously edited images (created with both free and Premium features) will remain accessible in the App’s in-app gallery and your device’s system album (as all data is stored locally). You may continue to use the App’s core free features without interruption, and no data will be lost or deleted from your device as a result of Subscription termination.
6. Modifications to the Agreement and Subscription
- 6.1 Agreement Updates: The Provider may revise this Agreement from time to time to reflect changes in App functionality, legal requirements, or business practices. Updated versions will be published within the App, and the revised Agreement will take effect upon publication. Your continued use of Vintx Premium after the effective date of the revised Agreement constitutes your acceptance of the changes. If you do not agree to the revised terms, you may cancel your Subscription before the changes take effect.
- 6.2 Subscription Modifications: You may upgrade or downgrade your Subscription plan (e.g., from a monthly to an annual plan) at any time through the App’s Subscription settings. Any changes will take effect at the end of the current Subscription term, and the price will be adjusted based on the new plan’s pricing and the remaining duration of your current term. Upgrading a plan may result in a pro-rated charge for the remaining period of the current term, while downgrading will not result in a refund for the current term.
- 6.3 Feature Changes: The Provider reserves the right to add, remove, or modify Premium features at any time, without prior notice, to improve the user experience or adapt to technical changes. The Provider will not be liable for any inconvenience or loss caused by changes to Premium features, provided that the core functionality of the Subscription (as advertised at the time of purchase) is maintained.
7. Disclaimers and Limitation of Liability
- 7.1 No Uninterrupted Service: The Provider does not warrant that the Vintx Premium service will be uninterrupted, error-free, or secure. Occasional temporary outages may occur due to device maintenance, network issues, or other technical reasons, and the Provider will not be liable for any damages resulting from such outages. The Provider will use reasonable efforts to minimize downtime and restore service as quickly as possible.
- 7.2 Content Ownership: You retain full ownership of all images you upload, edit, and generate using the App, including those created with Premium features. The Provider claims no ownership rights to any user-generated content. The Provider may use anonymized, non-identifiable data (e.g., aggregate usage statistics) to improve the App and Premium features, but will not use any of your personal content or identifiable data for this purpose.
- 7.3 Limitation of Liability: To the fullest extent permitted by applicable law, the Provider shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Vintx Premium, including (but not limited to) loss of profits, loss of data, or business interruption. The Provider’s total liability to you for any claim related to the Subscription shall not exceed the amount you paid for the Subscription in the 12 months prior to the claim. The Provider shall not be liable for any damages resulting from app store payment errors or delays, as payment processing is handled exclusively by the app store.
8. Governing Law and Dispute Resolution
- 8.1 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where the Provider is established, without regard to its conflict of laws principles.
- 8.2 Dispute Resolution: Any disputes arising from this Agreement or your Subscription to Vintx Premium shall first be resolved through good-faith negotiations between you and the Provider. If negotiations fail, you agree to submit the dispute to the exclusive jurisdiction of the courts of the Provider’s established jurisdiction. You may also pursue disputes through the applicable app store’s dispute resolution process, in accordance with their terms of service.
9. Miscellaneous
- 9.1 Entire Agreement: This Agreement constitutes the entire agreement between you and the Provider regarding your Subscription to Vintx Premium, and supersedes all prior or contemporaneous agreements, understandings, or representations, whether written or oral. This Agreement incorporates the App’s Privacy Policy by reference, which governs the Provider’s privacy practices in relation to your use of the App and Premium features.
- 9.2 Severability: If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
- 9.3 Assignment: You may not assign this Agreement or any of your rights or obligations under this Agreement without the Provider’s prior written consent. The Provider may assign this Agreement to any third party without your consent, provided that the assignee agrees to uphold the terms of this Agreement.
